Business Closure Policy

Radiant Health Institute is committed to protecting the interests of every enrolled student, honoring the integrity of our ICF accreditation, and ensuring that all professional, financial, and educational obligations are met, even in circumstances of unexpected or significant organizational change. This policy outlines how Radiant will manage a business closure, including voluntary closure, involuntary closure, and the permanent incapacitation or death of the Founder and CEO.

01Scope and Applicability

This policy applies to:

  • All currently enrolled students at any program level
  • All faculty, trainers, and mentor coaches under contract with Radiant
  • All ICF-related accreditation obligations and reporting requirements
  • Radiant Health Institute as a legal entity and operating organization

02Definition of Business Closure

A business closure occurs when Radiant Health Institute ceases operations, either permanently or with respect to one or more accredited programs. This may be triggered by:

  • A voluntary decision by the Founder or governing leadership to close or wind down the organization
  • Financial insolvency or inability to continue operations
  • Loss of ICF accreditation that cannot be restored within a reasonable remediation period
  • A legal, regulatory, or compliance matter that prevents continued operation
  • The death or permanent incapacitation of the Founder and CEO, where no qualified successor assumes operational responsibility within the designated continuity period

03Student Protections Upon Closure

Radiant's first obligation in any closure scenario is the protection of currently enrolled students.

3.1 Advance Notice

Radiant will provide a minimum of 90 days written notice to all enrolled students prior to a planned business closure. Notice will be delivered by email to the address on file and posted in the student portal. In the case of sudden, unplanned closure, including the death or permanent incapacitation of the Founder, notice will be provided as promptly as circumstances allow, with a designated representative or successor responsible for all student communications.

3.2 Refund Eligibility

Students who are unable to complete their program due to business closure will be entitled to a prorated refund based on the percentage of their program not yet delivered at the time of closure. Refund calculations will be based on:

  • Total tuition paid at the time of closure
  • Documented program hours and components already completed
  • Any outstanding balance on active payment plans, which will be forgiven proportionally

Refunds will be processed within 60 days of the closure date or, in cases involving estates or legal proceedings, within a reasonable period as governed by applicable law.

3.3 Certificate and Credential Protection

Students who have met all program completion requirements prior to closure will receive their Radiant certificate and all associated ICF CCE documentation before or during the closure process. No student who has legitimately completed their program will be denied certification as a result of closure.

04Student Records Preservation

Radiant will ensure that all student records are preserved and accessible for a minimum of seven (7) years following closure. Records include:

  • Enrollment documentation and signed agreements
  • Training hours logs and attendance records
  • Mentor coaching records and evaluations
  • Payment history and refund documentation
  • Certificates and completion records issued

Records will be transferred to a designated custodian or digital archive upon closure. Students will be informed of how to access their records and who to contact.

05ICF Accreditation Notification

Upon the decision to close or upon triggering events outlined in this policy, Radiant will notify the International Coaching Federation (ICF) in accordance with accreditation requirements. This includes:

  • Written notification to ICF of the intent to close or the triggering event
  • Cooperation with any ICF transition or teach-out process review
  • Transfer or formal surrender of accreditation status as required
  • Providing ICF with contact information for the designated closure representative

06Founder Continuity and Succession Planning

Radiant Health Institute was founded by and operates under the leadership of Surya, CEO. In recognition of the risk that the unexpected death or permanent incapacitation of the Founder could pose to enrolled students and ongoing operations, the following continuity provisions are in place.

6.1 Designated Operational Successor

Surya has designated a trusted operational successor who has been briefed on all programs, accreditation requirements, faculty relationships, and student obligations. The identity of this successor is documented in Radiant's private organizational records, accessible to the estate executor and legal counsel.

In the event of the Founder's death or permanent incapacitation, the designated successor will:

  • Assume operational responsibility for Radiant Health Institute for a minimum continuity period of 90 days
  • Notify all enrolled students, active faculty, and ICF within 14 days of the triggering event
  • Assess the feasibility of continuing operations, completing a full teach-out, or initiating closure
  • Communicate a clear student pathway within 30 days of the triggering event

6.2 Estate and Legal Executor Responsibilities

Surya's estate planning documents include provisions for the continued operation or responsible wind-down of Radiant Health Institute. The estate executor is authorized to:

  • Access all organizational records, contracts, student files, and financial accounts necessary to fulfill student obligations
  • Engage qualified coaches or administrators to maintain program continuity during the transition period
  • Coordinate with ICF regarding the organization's accreditation status
  • Facilitate refunds, record transfers, or teach-out arrangements as required

6.3 Continuity Period

A minimum 90-day continuity period will be activated in the event of the Founder's death or permanent incapacitation. During this period:

  • All enrolled students retain full access to the program
  • No new enrollments will be accepted unless the successor has confirmed continuity of operations
  • All scheduled classes, mentor coaching, and evaluations will proceed where possible, using existing credentialed faculty
  • Students will receive regular, transparent communication about the status of operations and their individual pathways

6.4 If Continuation Is Not Feasible

If, following the 90-day continuity review, the designated successor or estate determines that Radiant cannot continue operations with integrity, the Teach-Out Policy will be activated in full. All enrolled students will be offered either a prorated refund for the portion of the program not yet delivered, or a formal referral to a comparable ICF-accredited program willing to accept transfer credits, facilitated by the designated successor where possible.

07Faculty and Contractor Obligations

All faculty, trainers, and mentor coaches engaged by Radiant are expected to honor their contractual obligations through the closure or continuity period, including:

  • Completing any scheduled sessions with enrolled students
  • Submitting all outstanding documentation for student records
  • Cooperating with the designated successor or estate executor in student communications

Radiant will fulfill all financial obligations to faculty through the closure date, including compensation for completed services.

08Communication Standards

All communications related to business closure will be direct, transparent, and delivered promptly. All communications will be sent to student email addresses on file and posted in the student portal, free from ambiguity regarding student rights, refund eligibility, and next steps, and signed by the designated representative managing the closure or continuity process.

09Policy Review

This policy is reviewed annually by Radiant leadership to ensure alignment with ICF accreditation requirements, applicable law, and organizational best practices.
